General Terms and Conditions (GTC)

1. Scope of Application

These GTC apply to all orders placed via the quellkraft.at online shop, in the version valid at the time of the order.

2. Contracting Party

The purchase contract is concluded with Smart@Home Handels GmbH (Online Shop Quellkraft), Prinz-Eugen-Straße 35-37, 4020 Linz, Austria, FN 568570h, Regional Court of Linz (details see Imprint).

3. Conclusion of Contract

The product presentation in the online shop does not constitute a binding offer. By clicking the order button, you place a binding order. The contract is concluded with our order confirmation or delivery.

4. Prices and Shipping Costs

All prices are in Euro and include the statutory VAT. Applicable shipping costs will be displayed separately during the ordering process.

5. Payment

The payment methods indicated during the ordering process are available.

6. Delivery

Delivery will be made to the specified delivery address. Delivery areas and times are specified during the ordering process.

7. Retention of Title

The goods remain the property of Smart@Home Handels GmbH until full payment has been received.

8. Right of Withdrawal

Consumers have a statutory right of withdrawal. Opened or used room sprays are excluded for hygiene reasons (§18 para. 1 no. 5 FAGG). The direct costs of returning the goods shall be borne by the buyer. Details can be found in the Withdrawal Policy.

9. Warranty

The statutory warranty provisions apply.

10. Liability

We are liable for damages – except in cases of injury to life, body, and health – only in cases of intent and gross negligence.

11. Final Provisions

Austrian law applies, excluding the UN Convention on Contracts for the International Sale of Goods. For consumers, this only applies insofar as there are no mandatory provisions of the country of residence to the contrary.
